Posted - 28 November 2008 : 18:45:21 Hi, am just filling in my BR forms and not sure what to do about the cars. I own a MG ZR 1.8ltr which is worth about £2300, I did need it for work but have been made redundant. The thought of not having a car is petrifying though as I have a toddler and am pregnant, I also have diabetes and so have loads of hospital appointments to get to. Cannot imagine trying to get 3 buses to the hospital, heavily pregnant, with toddler in tow! Needs must I suppose! Anyway, my husband has a car which he uses for his work which is a Peugeot 207 worth about £3500. We are both declaring BR. My question is, if they take my car coz I dont work, then take my husbands car coz its worth more than allowed, where will that leave us? Would I be best selling my car before we declare BR? Or will the OR allow us to keep my car for my husband to use? Very confusing! Advice appreciated. x |

at this point you are not Br so your assets are still yours and provided you don't give them away you will be able to control the outcome.
There is no reason why your husband should not sell his car, buy a cheaper car which falls within the parameters, and use some of the surplus money to cover bankruptcy fees.
I would recommend you keep records of what happened to the cash, and the OR will accept this. Afterall petitioning for Br will cost £495 each and you need to find it from somewhere.
