Posted - 30 November 2008 : 21:38:46 Hi, Im 27 and am being made bankrupt on the 22nd dec 08 by Inland Revenue for about £8k. I also have other personal debts of £53k. I receieved a letter deleieved by hand to be to tell me details of the bankruptcy hearing which is in Strand, High cort London. I live in Norfolk so it isnt close. My questions is a follows: Do i have to attend the hearing as its not a summons and doesnt ask me to be there? I also dont own a house or car so what will be taken from me? I dont really owe anything of value. Could I go to prison for any of this? Have i commited an offence by not paying my tax on time, I was just trying to keep other creditors off my back. Please Help

Posted - 30 November 2008 : 22:03:53 Hi
you don'r actually have to attend as the process will go ahead with or without you being there.
The only way for you to successfully stop the process at this point is :-
a) have an agreement in place with HMRC to repay their debt within approx 12 months. However they will have offered several chances before this point.
b) to review an IVA and see if that is possible. An IP would be able to stop the proceedings to allow an IVA to be proposed but you MUST ACT QUICKLY.
You may also want to remember that the IVA would be around £400 ish per month for 5 years.
