Hi

I have booked my date for Bankruptcy it is February 26th 2009 at 10am, the lady on the phone said I just goto the desk hand my papers in, then I am taken to the judge and made bankrupt, should only take 20 minutes, not sure if thats right, but hope so?

Anyway a few questions:

1. When should I start completing my bankruptcy forms online
2. Ive just been signed off with depression, and if I go back to this job i am going to ask to reduce my hours to 33, therefore giving me an extra day off, should I reflect this on the forms, i.e that my income will be the new amount
3. I have come from a failed DMP and two failed IVAs therefore dont have any creditor statements what should I do
4. Reading the other post, becuase of my IVAs failing and also because of my car HP does this mean I will be a type 1 case
5. Is the £495 all I have to pay
6. I spoke to abbey bank today they dont accept bankrupts and as co-op and Barclays are both creditors of mine im going back to thinkbanking, thinkbanking said I dont need to declare the account on the form, is this correct? they also said that I need to declare the £12.50 fee, is this correct?

Sorry for all the questions, scary world, but I can start to see the light at the end of the tunnel hopefuly!

Thanks guys, just changing my DDIs over, as I have told Abbey now that im thinking of Bankruptcy they may close my account early

If the Thinkbanking account it open before you go BR you will need to declare it on your forms. You can put the £12.50 fees as an expense, but it may not be allowed by the OR. You would be able to pay for it out of your surplus though.

You are a little early to do the forms, i would have done them gradually and at your leisure.

You can get the CAB to check them, but its up to you, bare in mind it is a little while yet till your appt.

Hi Stu!

Hope you are well.

I am not an Expert by any means - I am sure someone will come along soon who is - but I have done a lot of posting and a lot of reading on here and I will try and help you as best I can:

Yes, that sounds right for the BR appointment - it is upposed to be quite a quick affair, as long as your paperwork is all in order.

1. It is probably best to start filling in the forms ASAP, especially if you are doing it online - you can do a bit at a time and save it and keep coming back to it. Remember though, the Forms should reflect your situation ON THE DAY YOU GO BR so you may want to leave some sections until closer to the time.
2. Yes - definitely reflect the new income etc. on the Forms - as above - situation on the day of BR.
3. Don't worry about the statements too much - it seems quite a lot of people are in this situation and apparently the OR can get hold of these if needed. Does the DMP / IVA Company have them? Maybe they could send them back to you? If they are online accounts maybe you can print new ones off instead?
4. Yes, from reading the other post, I would imagine yours would be a type 1 case, but not sure on this one.
5. Yes - £495 is all you would have to pay - in cash on the day of BR.
6. Co-op are also one of my Creditors. Someone on here has told me that they may still accept people after the BR for the Cashminder Account - this is what I am going to try anyway. Not sure about the fees etc. with Think Banking sorry.
