Posted - 05 December 2008 : 15:15:51 Hi, to everyone.
As the subject line says I need a bit of advice.
Total debts Me: £39000 with 8 creditors Her: £26000 with 9 creditors Joint: £1000 with 1 creditor
I'm starting to go through the process of spliting up with my wife. She hasn't been working for a long time and I have been supporting her.(housewife) If she is declared BR do I become liable for any of her debts? Except for the joint one that is, I can already see that they will just come after me, as I am the one earning!
Does it affect anything if she is made BR before/ after divorce?
I'm confident that I will be able to come to an arrangement with my creditors and eventually pay them off through a debt management plan.
I'm not keen to go bankrupt myself. But if there is no other option.
No house involved. Assets nothing of any real value. car £1000 tops. then all the normal household stuff. Newest thing is probably the tv which was bought 1yr ago.
Any advice would be greatly received.
Many thanks in advance.

Posted - 05 December 2008 : 16:45:19 Hi and welcome
I agree with Hammy, anything with your name on you will be liable for anything in her name will be included in her BR and you wont be chased for.
I hope that everything works out for you :-)

Posted - 05 December 2008 : 15:39:45 Hi,
If your wifes debts are unsecured and solely in her name then they will fall into her BR, her creditors cannot chase you for your wifes debt. The joint debt will most likely end up with you i'm afraid. |
