Posted - 06 December 2008 : 18:28:59 Hi Everyone, I join the forum a couple of weeks ago, But this is my first post, I have learnt a lot from you guys, Also it has helped me as I know I will not be alone. Well I will be going Bankrupt on 6th of January 2009 10,30am at Chelmsford County Court. I was issued my summons on Thursday, I was quite a relief, as now know the date. I can start preparing myself. I had a failed IVA, 1 year in I tried but I failed. I don't think the Inland Revenue wanted me to Succeed, as for the 1st 6 months I had to pay double the agreed amount, This got me behind on other things, The pressure got to much, so I failed the IVA.
Well that is a breif history of myself.

I agree with you hindsight is a wonderful thing, but please dont beat yourself up about it.
The OR will see that you tried and as far as the IR were concerned they just sound like they wanted blood out of a stone.
The main thing now is you are doing something about it, so feel proud of yourself and start looking to the future.

Had i known 2 years ago what i know now, i too would have been discharged now too.

Posted - 07 December 2008 : 17:44:34 Thanks guys for your kind words I was one of those people who struggled, thats why I did the IVA. I was given the choise, But Pride stopped me going down the BR route, Hindsight tells me I should havetaken a different path, when the IR demanded the extra payments, all that happened was I robbed Peter to pay Paul and got myself into further debt. If I had gone BR then I would probaly have been discharged by now. Hind sight is a wonderful thing.

No the stigma with BR is all but gone, no more being placed in the stocks and having rotten veg thrown at you :-)
It is better to take control and sort things out, we know that by the time we have made the decsion to go BR that this is our final road, we have no more choices, we dont take it lightly and to be honest, so what if it goes in the paper.
I know i have had only 1 person mention to me about it and i just said its the credit crunch.
I also know of others who are still struggling and its heart breaking because they are so scared, but i know that if only they found this site and read up some of our posts things would start to look up.
Anyhow, i always say u have to do what is right for you and yours and the first step is always the hardest, but it will be worth it in the end.

Posted - 06 December 2008 : 20:13:22 Hi Leakie, we didn't tell many people about our BR either, but the ones that we did have been really supportive too.
I agree with JO, it seems weird after all these years of worrying to be debt free, but it is such a revelation. I feel like the ball and chain around my ankles are gone forever.

I guess now will be the time , to find out who my true friends are, I have told only a few what is happening , and to be honest they have realy been suportive. well 1 month today to DFD (Debt Free Day)

Posted - 06 December 2008 : 19:22:15 I have kids too, and i think so far mine have been unaffected by my BR.
Sometimes i feel a little bit strange to know that i dont have any debts anymore, the creditors and debts ruled my life for so long, even 4 months down and i still feel something is amiss.
If you know what i mean :-)

Posted - 06 December 2008 : 19:15:22 Hi Jo it was not meant in bad way, It's just I can see that you are a very caring kind of person, as you say a New Year and a new start that is a good way to think about it. At the moment I just want to get through Christmas. at least my kids are to young to be affected by this, OH and I will make sure of that.

Posted - 06 December 2008 : 18:53:11 I had a funny feeling that you would be the first to reply, thanks Jo. The IP failed the IVA. I was advised to cease payments,
Leakie to make the IVA fail. This was just after 1 year in, a Creditors meeting was held and the IR were the only ones to want it to fail, they were owed a majority of the Debt so they really had the final say .

Is it you doing the petitioning or the IR/IP co.
As you have said your not alone as there are many of us on here all been through or going through the same.
