I am resident in Spain but domiciled in UK. The English courts accepted my domicile when my divorce was made under English law and they issued a child maintenance order. My only source of income is a UK Civil Service pension paid into a UK bank account. I face huge business-related debts in Spain but have no debt in the UK. If the Spanish court makes an order against me, can I file for bankruptcy in the UK?

Hi Dennis

while resident in another EU country you cannot petition for Br in the UK. The Insolvency Service now judge that when you step foot of the plane you are the problem for another EU court.

The challenge is that there is no "personal Br" in Spain so you need to review plan C.

I have received your email earlier but have only just got back to a computer so I will answer your direct email tomorrow if I may.

take care

Hi Dennisp,

Indeed you can. If you go BR in the UK, then it will wipe your debts worldwide.
