Posted - 10 December 2008 : 19:40:01 Hi, I'm a newbie here! my husband and I have decided to go down the bankruptcy line in January, after losing our business and having too much debt (from trying to fund our business, due to a customer taking us to the cleaners), I know that our Lloyds Bank account will be frozen as soon we start the process, however my husband (who has found a new job thankfully) gets paid by BACS each week, and we pay several standing orders i.e. gas etc, I have seen on here that the Co-op offer a bank account that is fine for Bankrupts, if we open one before we declare ourselves, will that be frozen too? I see one person says open the account, then transfer the DD & SO's over prior to BR, but I thought they would freeze all accounts? I'm sooo confused, can anyone help? Thanks, Rachell |

Posted - 11 December 2008 : 13:56:32 Ha..Jo, that made me laugh, that exactly what happens though, they called at 8.30am on Sunday, I thought it was an emergency call from my in laws or someone as no one calls at that time! But no it was Lloyds (our personal account/debts) asking for payment.
The funniest one by far, this goes to show I am already in a slightly better frame of mind, was Marbles credit card, they called yesterday and said you need to pay a token payment, can you 'borrow' a pound - yes a pound, from someone to send us!!! I had to laugh really
My husband has started to say, when you are rock bottom, which we are, the only way is up. Fingers crossed xxxx Thanks guys |

Posted - 11 December 2008 : 13:46:34 No i found them very very up themselves, i even complained to their head office about there lack of empathy and ubderstanding and how they would call me all times of the day.
They were our biggest creditor and they were by far the worst.
I even worked for them years ago, so i too had banked there since i was 16, but they had no code of conduct and i told them this.
I did get letters apologising, but in the end i had enough of their patronizing tone and i was extremely happy when i finally had the court number in my hand, so much so i could not help but call them and when asked are you calling to make a payment, i promptly replied no im not "IM BANKRUPT", that felt GREAT;-)

Once i actually admitted i had a problem things moved pretty quickly for me....you are right the first step will always be the hardest, but take one at a time and you will be running in no time ...Its so nice to be able to offer help and support to people in their hour of need , especially when we all know what your going through.
And Stuff lloyds you are much better off with coop (in my opinion)

Its been my pleasure and you know we are all here for you no matter what.
I am also glad that you have your Coop account sorted out now too.
I was with LLoyds and found them the most unsympathetic of all my creditors but hey there loss when you go BR ;-)

Posted - 11 December 2008 : 13:13:12 Thanks to you all for your kind words, you are all right, there are so many people in the same situation as me, and as a few of you say one you never thought you would find yourself in. Its a huge step to admit defeat - well thats what it feels like, but relief too that you have made that decision.
The thing I am most annoyed about is Lloyds Bank, I have always banked with them since I left school and now when we need them to be sympathetic to our problems they couldn't care less...literally, I spoke to our business manager this morning about paying our last VAT bill from our business acct and he said we won't honour it,no solutions, no ideas on how to get through it...nothing . Its not enough that we have lost our own business, and everything that goes with it, they have to heap the worry even higher!!
On a more positive note, I have now spoken to Co-op and they were fab, the lady I spoke to said 'we have to be realistic in these difficult times, and someone has to help people to get back on their feet' The application has gone thru' all the stuff should be here next week! I am sure I will be back soon after I have got the forms and need help filling them in!

As i answered in your other post it can be done before or after your BR hearing and like Jenny has said if they do freeze it you can get hold of the OR and the bank and ask they unfreeze it.
You need to make sure that you dont have lots of excess money in there when you do go BR as the OR may take the excess to benefit your creditors so take what you can before the BR hearing.
On a brighter note, we know where your coming from, i for one never ever thought about bankruptcy, it scared me and i just could not bring myself to even mention it, but i knew it was my last hope to get out of the very large hole we were in. I found this site about 4 weeks before we went BR and i am so glad that i did, these guys and gals got me through it.
We dont mind what you tell us (Within reason) we are all ears, if you have a worry anything we are here as your support. You must remember that you will never be alone, i know that may sound daft but your not, there is loads of us that are in the same boat and we can all pull together and get each other through.
Whilst you need the technical stuff you also need the friendly support and thats what we offer too.
Have a chat over a virtual cup of coffee, we are all here for you and yours, never feel ashamed, its not a shamefull thing, it has taken courage to get this far and you have to be strong for you and yours.

Posted - 11 December 2008 : 08:09:17 Hi Jenny, thanks for your reply. I'll give them a call today and set up an account, telling them that in the New Year we will be filing for bankruptcy, so hopefully that will mean if nothing else we wont have to that to worry about!
I NEVER, EVER thought my life would turn out this way, I'm sure like everyone on here we have worked hard all our lives, and now find ourselves in a situation way beyound our control. What a mess.

I also opened my Co-op Cashminder account pre Bankruptcy and was told it would not get frozen, however it did. After 1 phone call to the bank they immediately de-frosted it ....Just mention it to them when you open it and you will find they really wont mind. Its certainly the Account of the minute.
