i am considering bankruptsy, how would this affect my wife legally and financially, is it a personal bankruptsy to me?

Thank you for that, i suppose it would be at the discretion of the creditor then....Hubby has been given credit since my br and has had no problems as yet, and we haven't filed the notice either.

Thank you for letting me know, i will have to keep everything crossed it doesnt affect him

Onwards and Upwards is the way im going :-0)

I know a husband or wife can file a disassociation from their spouse but I believe potential creditors will view them as linked unless they are provably separated or divorced.

Hi Paul and welcome.

First of all i would say IGNORE the advertising from the previous poster, as they are just touting for business!!

I too went BR myself on 13 october. Do you have any joint debts or are they all in your name ? Do you own a house, if so how much equity do you have ?

So far it has not affected my hubby and as we are linked through credit filed we are allowed to file a notice of disassociation with them.

Please keep posting as the forum is great for help, support and a shoulder
