We are waiting for the finance company to repossess my husbands car. They appear to be stalling and only today called chasing payment and the lady appeared shocked that we were handing it back. This is despite them being told time and time again.

My question is, the car is parked on our drive waiting to be collected. Do we still have to insure it and can we cash in the tax and do a sorn declaration? It's costing nearly £100 a month to insure which seems daft to me as we are handing it back.

What a bummer!

Who was the finance co and how long was left on the finance? Also how long had you had the car?

Have you spoken to the company about this as i know my old finance company as soon as they knew we were bankrupt would take the said vehicle as they had a clause in there contract.

That is a shame though, what has the OR said. I would def get hold of the finance co as that would now become another debt in your bankruptcy and the OR will need to know whats going on too.

Try the helpline number 0800 078 9367 and see if anyone there can offer any more advice, they are a little busy so please leave a name and a contact number and they will get back to you, just be patient.

I declared myself bankrupt in Nov 08 and was told that I would be able to negotiate with my finance company for my mum to take on the repayments on my car. I have not missed one payment and the last one paid was 18th dec.7am xmas eve I had banging on my front door and a torch shinihg in the glass.It was the the finance company and he took my car away??
Have been in a shock since. I have a job and am a single parent.
How can they do this when my payments are all up to date?

He doesn't know, but I've bought him a scale model for Christmas, same colour etc and even has his number plate on it.

I was the same, I had a new, "performance" car, I took my private number plate off and kept it on retention, I cancelled the insurance and cashed the tax in but looking at the car every day on the drive, knowing I could never drive it again was just awful, so I rang the finance company and told 'em to come and get it ASAP, which they did in the end. Much less painful! I have an old battered Micra now, its a right old wreck, but so cheap to buy and run, it has never let me down (touch wood)

what a shame, it's a great car.
I'd like one of those myself.

But a car is a car at the end of the day I suppose.

Excellent, insurance will be cancelled tonight and we'll cash in the tax and declare is sorn. It's a Jag XKR so not a cheap car. I think it's his mid life crisis car :) Sadly, he was using his military pay off to pay for it but decided to put it into a business instead - and it all went wrong a year later. Still, he's happy in the car I bought him last week, bless him.

I put ours to sorn and cancelled the insurance. I also informed the finance co that this is what we had done and told them it was delvaluing everyday too, they came out within 4 weeks.
