I just have a few questions with regards to petitioning for your own bankruptcy, if anybody has any knowledge or experience of this your advice would be greatly appreciated!
Do you have to make an appt at the county court that deals with bankruptcies or can you just turn up on the day you decide you want to do it?
Do you know if there are currently any waiting lists at the courts as I have heard that there is?
My partner and I have lived together for the past 3 years although the utility bills (namely x 2 for EON and British Gas) have been in my name. They are chasing me for the debt that we owe, obviously my partner is liable for half of the utilities as we have been living together when the debt occured. I can prove this by rental agreements which is in his name. We want to put these into his BR. Does anybody foresee any issues with just adding his name to the acc. or just putting it into the BR? These x 2 providers are not supplying us with our gas / electric at the minute, we are being supplied by scottish power and are upto date with payments and the acc is in my name.

Yes I understand that this may be a problem.
I dont have an income or assets so there isnt much they can do, I will just have to put up with the harrassment until I can afford to go bankrupt!
I have just rang one of them and as it happens his name was already on the account anyway, its just the other one that its not, so not a big deal.

please be aware that to put your husband on the accounts now may look suspicious once bankruptcy is declared. However, as he is the sole income provider this can be explained to the examiner. If you leave your name on the accounts and are not planning to declare bankruptcy yourself then you will become liable for the full debt once your husband declares bankruptcy.
I doubt the providers will allow your name to be removed from the accounts whilst there are monies owed.

I misread the question about the utilities. As Skip says they can only go on your SoA and not on your OH's as they are in your name. If his name is showing on them at all then they could be included, seeing as they may not be then sorry but it can only go on your form.

Thanks for this, I shall get onto them tomorrow and find out about an appt!
We have looked at our finances and we can only afford for my partner to go bankrupt first (it seems logical to do it this way as he has more debt and is the only earner) and then I will follow within a couple of months.
If we cannot add in the utilities to his BR then I suppose we could hold them off for a couple of months until I go BR!

The debts that you talk about should be able to go into the BR as both of you are going bankrupt so list on both forms to be on the safe side.
You would need to call your local court and find out from them what the procedure is for the waiting times etc as some are turn up some as my one was is make an appt and then you turn up and the time you are booked in.
The fee is £495 for local courts x 2 if both going BR as there is no joint bankruptcy and if its the high court in London the fee i think is £507 per person.
You will also need to find out how many copies of the form they will need, mine needed 3 some courts say 1 and they copy it, but again ask as there may be a fee if they copy it for you.
