Posted - 28 December 2008 : 14:53:24 hi, when filling in the forms do i fill one in with my debts on, one with my OHs on and one with joint debt on,or just one form with everything on? sorry if this sounds a daft question but im a bit confused, thanks |

Posted - 29 December 2008 : 17:09:04 At the end of the day a car is a car. Some uninsured driver could write it off tomorrow & you'd get nothing for it. If that is the only thing holding you back then try & change your thought pattern, it's people bot things that matter & at the end of the day it is only metal!!! |

Posted - 29 December 2008 : 16:50:44 It may be worth getting a free valuation on the car and see what its worth,
If you need it for the kids etc then there may be a good chance that you may be able to keep it. The OR may at there discretion offer you to buy the difference if the car is more than the allowance and then again they may be nice and say you need it so beit. But i would get the valuation done i have links in my blog and also work out that you def need it for work, school etc.

No that should be ok just make sure that there is only enough money to pay the DDs left in there on the day of your bankruptcy and remove the rest.
The Coop seem to leave the accounts alone and dont close them but its better to have the money to one side just in case.

Posted - 29 December 2008 : 16:40:02 hi, on another note, i have just opened a cashminder account today over the phone and been accepted (subject to whatever they do) have i opened it to soon or should i have waited till BR it is only for WFtax credit and CB and wages to be paid into and mortgage and that to come out? thanks |

Posted - 29 December 2008 : 16:26:02 hi,my husband doesnt drive so i take and pick him up from work as he has quite unsociable hours, im not working at the moment but hope to soon, there is no finance on it, ive had the newer one 1yr 3mnths, in my head im all readyfor BR but the car issue keeps jumpimg out at me, sounds daft i know, thanks. |

Yes the helpline can offer verbal advice and more of it than i can, my knowledge is somewhat limited as i am also a bankrupt that has learnt from my own experience and so offer over advice on subjects that i have some knowledge on.
I would def give them a call and see if they can give you any more advice regarding the car.
Just thinking do you need it for work and also is there any finance on it. How long have you had it. I mean the newer car not your old one as the older one will more than likely be taken by the OR as it would be surplus to requirements and would benefit the estate.

Posted - 29 December 2008 : 15:35:32 hi, thanks jo, I spent yesterday afternoon reading your excellent blog, great information and links. when you mention how the helpline may be able to help with information regarding my house and car do you mean they will have more ideas as to keeping those assets? my house has N/equity but i have an old car standing im my drive with no MOT worth about £1,000 that i havent been able to sell since i bought the car i use now and couldn't bare to lose, thats worth £3,800, sorry to ramble but my car seems my only hurdle to me going bankrupt. really grateful for your help everyone,thankyou |

When u say seen together do you mean go into the court together?
If you do then yes you should be able to see the judge together and the clerk.
When you have your interview then no they are seperate im affraid.

On your copy fill in all your single debts and include any joint debts, on your OHs copy include all his single debts and all joint debts. There is no need for a 3rd copy just one each is enough.
So you have one and your OH has one.
You both need a copy of a statement of affairs to take to the court so one is yours one is your OHs.
So you need to fill out the form twice a set in your name and a set in his name.
Technically its one form for you and one form for him. You dont have to list all of his debts on yours only what is joint and vice versa on his. The reason you have to have one each as they dont do a joint bankruptcy they are individual.
