Posted - 30 December 2008 : 11:26:04 Hi there, as I mentioned before, I am going for personal bankruptcy, and also closing down a ltd Co business, which is a shop.
I am about to fill in my personal bankruptcy forms and have a question.
I have a property in Spain, (in arrears with the bank as have not been able to pay the mortgage on it for a couple of months, and in negative equity, will be handing back the keys, or just walking away from it, dont know what to do yet, trying to sort out UK first).
I owe the development maintenance company some money, and I think also the wealth tax (Wealth ha ha) on it.
Should I put this on my bankruptcy form? i.e. the name of the maintenance co? or because it is Spain, does my UK bankruptcy not apply to this?
Thanks for all your help so far, just finding this forum has been a life saver. I took all advice and have given the help line a call. I may also ring Paul from Reviva direct if thats ok, because I am really worried about the closing of the business side of things, and really don't want to do anything wrong.

the mortgage itself is of course a secured debt so will not be included in the bankruptcy. The details of the Spanish property and the associated mortgage should be entered in Section 4 (secured) of the Statement of Affairs.

yes you should include all debts worldwide. Re the limited company I would certainly get some expert advice and Paul at Reviva has a very good reputation in that area so please go ahead and give him a call.
