ok.This is it. I have no choice but to go br but i'm so scared.Firstly, when friends and family have wanted to buy things i have got them on my credit cards and they have given me the money, which i have paid off my cards....but it now shows that i have made payments of £500 a month plus bank loan payments etc.I'm on benefits and do not recieve anywhere near what i have been paying.The problem is now the credit has all run out and i cannot make even meet the interest payments.will i be prosecuted for fraud? helppp plz, i have to take responsability, i have lived with my head in the sand for long enough.I don't know what other option i have, i owe £25000. |

The OR does tend to write to landlords to confirm the amount of rent and to see what type of tennany you have. AST etc etc

I don't think the OR would notify them of your bankruptcy and I am not sure if you are duty bound to inform them yourself of it. Please check the tenancy agreement to see if you must notify them.

The landlord may decide to do nothing as you have been good tenants but Paul's suggested letter sounds perfect if the problem arises. Like RHB says, it's probably a get out for the landlord for tenants that have got into arrears

I wou;d imagine the bankruptcy clause is put in as a way to remove tneants thAT MAYBE haven't paid all the time. I think if i were a landlord i would rather have someone in a property that i knew paid up on time, even through having money difficulties. |

I agree with Paul here, i would hold fire and not say anything unless you really have no choice as clearly you are the model tennent regardless of your other debts.

I agree, it would be in the landlords best interest to keep us regardless of what the agent thinks. Thanks for taking the time and pointing me in the right direction it's definately worth a try.

Hold your ground in that it is always worth a conversation with the landlord rather than the agent
i.e..
Dear Mr Landlord I realise that I have gone Br however there are many benefits in me staying rather than leaving
Benefits
Proven payment record
no trouble to neighbours
no outside debts that will jepordise future rent payments
cheaper to keep me.
If I leave you will need to pay the agent money to find a new tennant
you don't know what they will be like
the property may be empty for X weeks while a tennant is found
all these negatives could cost you a lost of money.
Isn't it safer to stay with what you know than risk the unknown?"

I'm not sure what you mean by hold my ground. I thought if i'm breaking the tenancy agreement then i have no choice but to leave. I just don't know how all this works.

Hi
if they ask you to leave they will need to give you the 2 months notice, however you do need to hold your ground because with 5 years and no arrears you are what I would call a model tennant.

I have a question, hope someone can help . The house we live in is rented from an agency, there is a clause about being br on the agreement so i guess they will want us out:-( we have lived here 5 yrs and have no rent arrears) but does anybody know how much notice to leave the agency will give us? I have so many things going on in my head i feel dizzy. |

Hello Les, I know exactly how you are feeling, I am having to go BR, probably around the end of this month, I am so scared as I have also been absolutely stupid, I owe considerably more than you and am worried about the after effects, especially the OR meeting. This site has been brilliant and has helped me get through the last few months, let us know how you get on.

Thanks for your replies. I am so pleased to have found this site, It makes things easier to be able to speak with people that have been through it and know exactly how low and scared i feel and how it is to not be able to sleep with worry about all the "what ifs". I have been stupid so stupid, my only way forward is with br. One thing for certain is that over the next couple of months I'm sure going to need the help and support of this site !!!
