I suppose I should know all the answers by now but I don't.

I have listed a couple of personal cheques totalling £250 which my old bank failed to honour (even though they were cashed with a guarantee card) on my bankruptcy but the creditor concerned passed had already passed them on to a collection agent. I called the collection agent and he claimed that personal cheques ARE NOT covered by bankruptcy. These are the type where you go to some cheque cashing outlet and get a cheque cashed and pay it back later in the month and pay a percentage fee.

Is it true that personal cheques are not covered by BR?

Hi Pix1,

I think they're just trying it on. Give the collection agent the OR's details and insist they contact them to discuss. If they refuse, use the old Section 40 of the Administration of Justice Act trick (harassment).

To clarify, personal cheques are drawn on a personal bank account and therefore unsecured debt which IS included in BR.
