Hi all,

I am in a predicament and could do with some opinions.

I have been on a NT code since September and have approximately £2k of unpaid sat in my bank. I was told that an agent would be in touch to arrange for me to pay the tax as part of an IPU. In september i contacted my OR to ask where i should be paying this money to and was told that somebody would be in touch. It is now 4 months since i paid tax and nobody has been in touch. I have recently had a family bereavement and have been asked to help with funeral costs. Now my heart says family comes first and to use this money to help, my head says there is no way the system will forget to chase the unpaid tax. If i was to spend the money and then the agent came looking for payment and i told them i had spent it would i be looking at criminal charges? I want to do the right thing but i also want to do my best for my family. Opinions please.

Hi Hammy,

I would not touch it if it were me, just keep it where it is. There is an old thread from months ago where this happened to someone else. As it turned out he was discharged and still had the money, there was some loophole saying he could keep it as he was discharged/new tax year etc, or maybe he hadnt signed anything. I dont quite remember, just remember Julian advising and me thinking 'jammy bu**er'!!!!1

I would hang on until the end of the tax year and your code reverts back, then seek advice from Paul or Julian.

Dont tell your family about the £2k, pretend its not there. What would you have done then? If you dont have it, you dont have it!

Thing is, you are only on nil tax cos of your bankruptcy, if you weren't bankrupt you wouldn't have the money cos it would be taken off you at source in PAYE Jo is riight, leave it there, let it get you a bit of interest but don't spend it because that is not what it is meant for & I feel certain you would get into a lot of trouble for spending it.

Be upfront with your family, sau you are bankrupt & have no spare money BUT you can help in all sorts of other ways that don't cost money, eg making arrangements, childminding someones kids etc etc.

Oh i am so sorry about your predicament. I do understand where your coming from and i would feel torn too but i know that if i had that money i would leave it for the OR as tech its not ours if you know what i mean, now that is what i would do and is only MY opinion of course.

I dont know how the OR will look on it, not favourably no doubt but other than that i cant help you.
