Posted - 07 January 2009 : 21:14:23 hi all i came on here a few months ago for advice,i didnt have the money at that time to go BR,but in 2weeks time i will have enough. for months i have buried my head TOTALLY in the sand,ignoring letters and knocks at the door,now its out the sand and i'm crappin myself!! i dont know where to start on going BR!! i know i got to do it but i want to bury my head again! can anyone give me a little advice on where to begin?! thanks staceb |

Posted - 13 January 2009 : 12:03:49 Stace - have you taken advice? You really need someone to speak to before making such a decision. And you also meed to ensure you have everything in order prior to actually going BR. It isn't a decision to be taken lightly and without being fully informed.
Call the helpline, CCCS, Citizens advice bureau or similar. Just so you know what is best for you, what will happen and hows to fill the forms in if BR is the best option.
I know there is a new scheme coming in about April time specifically for people on low income who have debts of less than £15000. This may be a better option for you.
The last thing you want to do is rush into a decision - take your time and get advice.

Posted - 08 January 2009 : 20:31:05 Hi Stace b Don't be scared, it's not as bad as you think, I have just gone Br on Tuesday just gone, The Judge was very good, I have just recieved my letter to contact the OR, I was scared untill I found this forum, but the support I have recieved has made me positive, for the future, I know it will be hard for a while, but at least you will find it hard with a debt free future, most people will be struggling with there debts through this credit crunch, at least we will have a fighting chance,and will probaly come out of it stronger people,

The BRU is a bankruptcy restriction undertaking a BRO is bankruptcy restriction order.
These basically are slapped wrists given by the OR.

The BR will last a year and then your discharged. Some people are being discharged early. As for the proceedings you may have a couple of hours att the court, then an interview which could be say 1-2 hours depending on the case. This will take place after the hearing could be a few days later or a couple of weeks again dependent on the office.
I would not worry though, even with these BRU's they are just slapped wrists and at the end of the day who wants more credit anyhow.

The help and support that there is on this site will help us through and remember you are not alone. |

Well the first part you have done you found us :-)
You will need to call your local court and find out if you have to make an appt or can you just turn up.
For your local court check this out:
http://www.hmcourts-service.gov.uk/HMCSCourtFinder/
Then you need to fill in the forms which are available from:
https://www.insolvencydirect.gov.uk/isolv/
You need to make sure you have the correct fee ready for the day in cash which is £495 unless you can get help which would mean a reduction of £150 but ask the court when you call as certain benefits and low incomes may entitle you.
Any questions your unsure of post on here and we will help you.
Do you have any assets that need protecting.
