Posted - 07 January 2009 : 23:28:10 owe approx 24000 to 3 different lenders (unsecured).debt was built up in my name durin marriage.got divorced. he kept house &debt was in my name so i continued 2pay this as i lived with my parents-approx 500 each month.july 08 i moved in2 rented accomodation with new boyfriend&i then lost my job.my boyfriend works full time,is only 23&do not have children.do not receive help with rent/poll tax etc.i receive jobseekers allowance which was 47 pw,now 60 as in dec 08 i turned 25.i cant afford 2pay anything 2creditors-2make ends meet i have to use all my 60pw 4bills 2live.unemployed 6 months now.hassled with up2 50 - 60 missed calls a day-stopped answering coz they do not listen 2me when i say it impossible 4me to pay them.if i found employment by the time i paid half of bills i could not afford 2pay my debt as the highest paid job ive ever had paid 900 pcm.i have no assets-NO car,no business,no home...i have nothing to loose. i dont intend on being a lawyer/accountant/police person and i am unemployed. would i qualify for bankruptcy if ive only been out of work since july 08 &managed 2make payments up until sept 08?

Posted - 09 January 2009 : 08:35:51 would they go after my old house which was signed over to my husband for £5000 back in August 2007? I know he has done work to the house since and lives there with his current girlfriend and child? When i signed the house over he refused to let me know how much the house was worth when he had someone in so he could remortgage. i moved taking only my clothes and had no interest in anything as i wanted a quick divorce and cut my losses.

Posted - 08 January 2009 : 00:02:58 hi. thanks for your reply. basically i receive 240 pcm jobseekers allowance which is 12.52 short of just the one loan payments... i would have to find an additional 260pcm to cover the three payments for all my creditors. the house was in joint names from 2005 until 2007 when i signed the house over to him so for about 18 months it has been in just his name and he now lives there with his new girlfriend and baby. im not sure what the value was when i signed it over but i know we bought it for 52,950 back in 05 and we had 100% mortgage. i dont keep in touch. the reason i just signed the house over and walked away because it was a horrible marriage and i wanted a quick divorce and just wanted out!
where do i begin?? how many payments do i have to miss? do i let them know i'm filing? im confused and scared!... divorced and heading for br at 25!!

Posted - 07 January 2009 : 23:50:06 there is no reason at all that you wouldn't qualify for Br.
Primarily you need to be able to demonstrate that you are unable to pay your debts when they fall due , and that your assets are not able to cover the debt.
Was the married house in joint names and was there any equity in it.
Potentially the Official Receiver might be interested in looking to see if you have a claim on assets from the marriage.
