Posted - 08 January 2009 : 17:23:38 My husband and I declared ourselves bankrupt in September 2008.
We have just informed the OR of a bonus paid to my husband in December, of which they are asking for ALL of it. Is this normal???
We were of the impression that any overtime or bonuses are shared between the OR and the person receiving them.
Can anyone shed some light on this before we have to hand all the money over?

Posted - 08 January 2009 : 18:38:20 melanie from IVA site has confirmed that this is correct and there is no provision to share a bonus between receiver and the creditors!
this seems quite unfair, especially if it is a performance related bonus! it does not give people the incentive to work hard!

My husband gets a profit related bonus paid every quarter. This one was £500, NET. We did consider spending some of it as we could really do with a new radiator in our bedroom but we want to do everything by the book so have informed the OR!

Sorry i cant help you with this one. What sort of bonus are we talking here, was it a very large amount as you may be able to negotiate with them, esp if you have spent it.
