As I understand it if I told some lies on applications to get credit then this is fraud and as fraudulant debts cannot be cleared in BR there is no point in going BR. Any suggestions what I do now? I never took out debt with the intention of not paying, the agreements are from 2 yrs ago and i have never missed a payment but now it's just all too much. Just been online on my account and in profile it says HOMEOWNER when in fact we rent.Arghhhhhhhh.
Another sleepless night!!!!!!!

Just don't know what to do anymore. Can't pay crediters, can't go BR, can't see any light at the end of that very long tunnel. All my own fault tho.

Les

Please please give the helpline a call - just talking to your situation through will make a huge difference.

Please dont think that doing nothing is going to be better as it will be constantly worrying for you.

Take care

Les

I cant stress this enough, may i suggest a call to our helpline, i really think you need a chat with someone with more knowledge than i have and can then go over your case more thorughly.

I do think that if the debts are unservicable then you have little or no choice but to go down the bankruptcy route.

Call them, its free, that number is 0800 078 9367.

Thanks for your honesty Julian.

Think I'm looking at 2 yrs tho. Not only have I lied on the applications but also lived a life I cannot afford, holidays etc and now all the credit is it at the limits, not looking good for me is it!!!
Don't know what to do, I can't pay what I haven't got but should I really take the risk of BR?
Ohhhhhhhhh what have I done..............

I suppose at least in prison I would get 3 meals a day which is more than I get now!!!!!!!!!!!!

Les,

The main thing is to tell the truth on the BR petition. It is unlikely the OR will go into minute detail as to exactly what is on the forms for credit. That said, though, the brus and bros do show people with small scale fiddles like that. Haven't we all taken out loans and said it was for home imrpovements when, in fact, it was for a holiday or something? My gut feeling is that you will be ok and, certainly, such fears are not sufficient to give up on BR as your salvation. Good luck.

Hi Les,

The good news is that I have never heard of an occasion where a lender/the OR has re-checked the original application form during a BR. As someone who worked for one of the major high street banks for the best part of 10 years, I know through experience that most people "bend" the truth a little when applying for credit.

I do have to stress however that saying you own a property when in fact you rent, and saying you worked when you didn't is most definitely fraud (obtaining money by deception) which would more than likely mean 6 months at Her Majesty's pleasure if it ever came to light.

Hi Les, Jo and movin on are right, although I didn't lie on my application forms, my bank has lent me so much money without doing any checks whatsoever, a loan of £11,500 another of £10,000, 2 credit cards with a £3,500 and £8.750 limit on them plus an overdraft with a £4,000 limit, and I only have about £950.00 coming in!! Any sensible bank would realise that I could never pay all that off, so the banks are very much to blame and deserve to lose the money.
I would try and move on and start afresh, I don't know how much you owe, but at the end of the day I think they have bigger fish to fry.
Good luck

Hi Les

Make sure you remember that "they cant have what you haven't got"

And as for the BRO/U then if you do get one its only supposed to be a harsh telling off and keeps you under br restrictions.

Thanks Jo
What would we do without you, you're always there to reassure.
If my debts are gone and I can live again then getting a BRU/BRO ufff who cares. I was just worried that after all this they could say I still owe the money as I obtained it fraudulantly by lying. Whatever they can't have what I just haven't got. I so don't know what i would do without this forum!!!

Needafriend Posted - 09 January 2009 : 09:06:07
Hi Les

Why would you go to prison. I dont think that this cases alarm bells ringing, many of us took things and slightly changed the truth to our advantage and to be honest the lender should have done their calculations and looking before they let you have it so really they are as much to blame as you.

I know that in the past they just wanted to lend, lend, lend and now obviously they cant.

Our remortgage was adapted by our lender so that they could lend us the money and we did not have the wages coming in that they wrote down so basically i would say dont worry and go for the BR. If asked the bank is as much to blame as they should have done proper checks, dont take all the blame yourself.

The worst you would get is the BRU/BRO and thats not that bad.

Take care
