Posted - 10 January 2009 : 23:23:13 went bankrupt friday.got telephone appointment with OR 22ND JAN.what does this entail.what questions will she ask.had debt of almost 30k.2 loans and various other things.cant exactly remember where it all went.had shift change in work which meant change in pay structure.will she contact employer as no one in work knows my situation.in the end i was taking from 1 card to pay the other.used to do alot of overtime which would cover everything,but last year spent a spell in hospital with heart problems.only38 yrs old totally out of the blue and scared me to death.on medication now to keep it under control but dont work my socks off now as my health is more important.i have a letter off the doctor to prove i was in hospital.will the or want it.just expecting OR to take me to the cleaners,even though after all the bills are paid we live off my partners wage.she pays for weeekly shop,stuuf for kids etc.she also has her own debts to pay but only small but there none the less.sory for the long long question.ps thanks to everyone who has answered my previous posts. |

Posted - 11 January 2009 : 09:09:25 The good thing is that the examiner will probably go through your petition line by line and so oyu will be able to anticipate the questions. They will be interested in when debts were run up. Generally, the further back debts go the better it looks. people running up more recent debts may be questioned more closely. This all depends what your debts are for. Your health problems can be clearly seen to have contributed to your debt situation and this will look better.
One item I can immediately see that you can put down as an essential expense, by the way, is for an NHS pre-payment certificate.
"From 1 April 2008, the charge for a single prescription item is £7.10, whereas a 3-month PPC will cost you £27.85 and a 12-month PPC £102.50. The most convenient way to pay for your 12 month PPC is by Direct Debit meaning you can spread the yearly cost evenly over 10 monthly instalments."

You can only claim up to the value of, probably, either the 3 month or the 12 month certificate, according to the Insolvency Service rules - which the examiners use. If you have not already put this down on the petition you could still ask if you could apply for it in your interview - the examiner will say yes - and this would highlight your illness to him/her.

firstly the examiner will want to get a clear picture of the circumstances leading to your bankruptcy. From what you have written I am sure the reasons are plain to see and perfectly acceptable as an unfortunate turn of events that could not have been foreseen.
The examiner will not contact your employer and will let you know if they want to see your doctor's letter, I doubt they will.
