we are going bankrupt tomorrow, and are giving up our house, Im well nervy but its the only option, we have found a property to rent, will we have trouble with our references?what is the way forward there? and when we give up our property, which is n negative equity and has a mortgage and a loan on it, who do we send the keys to? we have a car on hp which my husband really needs for work will we be able to keep it do you think?many thanks for your help!

Hi Janni Jan

little worried that you are a little premature for tomorrow.

Do you have any mortgage arrears?
Do you have funds for a deposit for rented accomodation?

If you petition for bankruptcy first then you will definately need a lot more than 1 months deposit. It is usual to not pay the mortgage and secured loan for 3 - 4 months and use these funds to cover the home move.

What car does your husband have and how much is it worth?

If it is worth more than £2000 and you want to keep it you will need to find the different in cash VERY quickly. Otherwise the OR will collect the car and is likely to send you a cheque for £2k to purchase another one.

If however the car is worth under £2k then your husband is fine provided that he needs it for work.

apologys in advance if this doesnt come out right [just registered on here] we are in a very similar situation to you when we gave our keys back to the lender we made sure we were safely in a rented property first before telling our lender we were sending keys back we still havent gone bankrupt yet although put the wheels in motion today have enlisted a bankruptcy specalist help though too daunting to go it alone.
its now a year since we moved into rented.
Ive been told if your cars worth £2000 or less and you use it for work you should be allowed to keep it.
