Posted - 16 January 2009 : 08:09:35 I have just gone bankrupt today, what a relief. My concern now is that thinking about it,I may have committed fraud. I took out more credit cards & the bank gave me loans to consolidate my debts. I have always been self-employed in the construction industry and because of the current climate had no work for nearly a year, but was given these cards & loans by my bank who I have banked with all my life, as well as other card companies. I got these loans and cards 3-4 months after my last job, but have been looking for work constantly, so I can pay off my debts. But, for the last 6 months have been living off my credit cards on the hope I get some more work and pay off my debts. I have never been in debt in all the time I have been working. So any advice, do you think I have anything to worry about?? |

Posted - 16 January 2009 : 11:58:53 Well done scooter we are going br in the next couple of weeks i think most people on here can relate to your situation.
Surely theres a difference using a credit card just to survive than using one to go on a round the world cruise. I have a credit card thats maxed out but the other day they sent me half a dozen blank cheques its like whoever sent them is saying go on use them you know you want to then we can charge you an over limit fee. Does the OR not take into account that banks are sometimes partly to blame for the situation people might find themselves in. |

Posted - 16 January 2009 : 11:08:38 Oh this is worrying! What is the offical line on this one? I went BR last Friday. I have just checked teh online register and it says i will automatically be discharged on 9th Jan 2010 - can this change? I have my interview with the OR on Monday. My debits where from living beyond my means - could that be be fraud? |

Posted - 16 January 2009 : 10:25:29 Hiya Scooter We find ourselves in a similar situation, when the OR spoke to me he said he would likely put a restriction on my bankruptcy extending it beyond 12 months as I didnt deliberately commit fraud, i used credit cards etc with the intention of paying them back, I just lived beyond my means, I dont know if that reassures you at all!
