Myself and x are both going bankrupt. I have large gambling, online poker debt she also has some gabmbling debt, I fully accept my fault but you just get deeper and deeper. My main questions are will it take longer than 12 months for discharge, will I be able to keep car worth about 2k as i have my kids at weekend and travel 10 miles to pick them up. I'm also guessing that i could do with finding somewhere to rent before going bankrupt ?

Hi Hopeless,

As long as you cooperate with the OR, discharge will still be automatic after 12 months. However ,due to the gambling losses, you will likely receive a BRO/BRU which will hold you under the restrictions of BR for anything up to 15 years.

The car falls below the £2,500 limit allowed in BR. As long as you can justify the need to the OR (ie. To get to/from work etc), you should be able to keep it.

Definitely get into the rental prior to BR. If you wait until afterward, it is likely the letting agents will insist on 6 months rent in advance.
