evening everyone.got my OR interview tomorrow and im needless to say nervous. i have my statement of affairs ready to go through,with them.did most of my banking online and have struggled to get statements to go through as to regards where i spent the money etc.as i was in a situation where i could afford the payments no problem i never took much notice of the statements.as it was online i never printed them off.then suddenly due to shift changes and decrease in income plus health problems leading to aspell in hospital.i will just have to try and remember .also as to regards my partners income.she only earns 180 a week which is what we live on basically.all the debts were in my name and it was i that went bankrupt.she really didnt know the situation i was in till the end.i am luky she is still with me.as i pay all the bills mortgage, secured loan, maintenance, gas, elec etc,can the OR REQUEST ANY OF HER MONEY or make her sell her car.sorry for the long post

hello everyone.had my OR phone interview this morning. on the phone for an hour.the lady i spoke to was really nice.she was very understanding.waiting for letter now as to regards the outcome.as no equity in the property will be given the opportunity to buy the beneficial interest.Was worried that i might lose the house, so that is good news.alls i would say is be honest to them.everyone has there problems but they are not there to judge you.hopefully now i can get my health back on track.i tried my hardest not to go bankrupt but in the end there was no other wayout.i would like to thank everyone who has helped me on this forum and has sent good wishes.i will keep you informed as to the final outcome.keep smiling

You must list the CB but it cannot be included by the OR as income.

thanks john for your answer.when we add up both our incomes then take away all the bills that we have to pay,ie everything we only have about 30 pound a month left.this is what we use for going out places etc.not much when you have a6yr old and 15yr old.ps do they include family allowance as part of your income.cheers

Hi

in a nutshell no.
Her assets including car are safe.

If you have declared that your household income, including your partner's, exceeds your essential expenditure or the examiner revises the figures and you have a disposable income of £100 per month or more then the OR will make a claim by way of a monthly income payment agreement which lasts up to 3 years.

If it would have meant a minus DI per month if you had not listed your partners full income then effectively yes it would be as a result of her income that an IPA was proposed and therefore her income which will be affected.
