when the OR applies for early dischrge what actuelly happens ? am i right in thinking e asks our creditors if they are happy with this, and what happens if they say no ?

Hi Hanlou,

The amount of debt makes no difference as to whether you are considered for an ED, it's entirely at the OR's discretion.

wow fantastic, its sooo strange cos you poop yourself for so long wondering what will happen etc, then to be told on first interview you are looking at early discharge......wow, he didnt want any bank statements etc, just said we filled in the forms so thouroughly that it was all there to see, so thats a top tip for anyone else at the forms stage !!!!

If it helps, I was discharged after 7 months. Apparently it would have been earlier, but the examiner at the OR office dealing with my case left and forgot to pass it to a colleague!

oh thanks julian,
thats fantastic news, the OR aid to me yesterday, that in 3 months time he would send out a I & E form, but was looking for discharhe in 6 months due to it being so straightforward, i could not believe it !

Hi Joella68,

when the OR is considering early discharge, they'll send you an ED questionairre for the purposes of assessing IPA/IPO p[ayments. In addition, they will write to all of your creditors to see if they have an objection to ED. If not, they'll process the paperwork and send your file back to the court for ED.

If your creditors do object, it would depend on the nature of the objection. Following your initial interview with the OR, the OR would have sent a report to all your creditors, so most objections would happen here and then be investigated. It is rare that ED is declined due to a creditor objection.
