Posted - 22 January 2009 : 19:06:55 I was planning to file BR middle of next month but after reading various experiences maybe I should wait. I too was spending right up to Christmas on credit cards. I don't think I really acknowledged the amount of debt I'm in until recently and as soon as I did I gathered as much advice as I could. Every single advisor said to declare BR was my only option, so typically of me I wanted to get it sorted like yesterday! I have struggled with payments for months now - going without essentials for the family to cover payments etc but when I made the decision I stopped paying the CC bills. Should I pay at least a nominal amount to each company until I'm ready to proceed? I don't want anyone to think I'm trying to avoid my debts but the realization hit me like a sledgehammer and as I said before once the decision was made I wanted it done asap.

I dont think it will be too much of an issue. the cards are not news ones that you have used and i take it you have made payments before.
I cant see why next month would be an issue.

Posted - 23 January 2009 : 14:55:51 Would it be bad to file the papers next month? I just want to start again.
Also a few days ago I cleared a couple of catalogue type debts from Christmas. It wasn't for large amounts, and before I knew anything about preferential payments. Now I worry that I've done wrong. |

Posted - 23 January 2009 : 14:55:39 If you know your going bankrupt and soon stop paying now.
You can save that money for the fees etc.

Posted - 23 January 2009 : 13:50:59 Hi Leahk,
I think speaking to your creditors and at least making token payments would be adviseable until you're ready to go BR. I would caution against letting them know you're going BR for now as they'll just commence legal action.
