Posted - 23 January 2009 : 09:05:20 HI I HAVE DEBTS THAT I HAVENT PAYED IN A LONG TIME AT LEAST A COUPLE OF YEARS AS I MARRIED AND CHANGED MY NAME, AND MOVED ADDRESS.I AM FED UP OF WORRYING WHEN THEY WILL CATCH UP WITH ME AND WHO IS KNOCKING THE DOOR SO HAVE DECIDED TO GO BANKRUPT I HAVE A COUPLE OF QUESTIONS FIRST WE HAD A SHORTFALL IN OUR MORTGAGE OF 43K WILL BANKRUPCY CLEAR THIS AND I HAVE A BANK ACCOUNT AND PO ACCOUNT THAT BENIFITS ARE PAYED INTO SUCH AS DLA IS CB ETC HOW ARE THESE LIKELY TO BE PAYED IN THE FUTURE DO I NEED TO INFORM THEM AND WOULD THERE BE ANY DELAYS IN PAYMENT AS I HAVE TWO YOUNG CHILDREN ONE WITH A TERMINAL ILLNESS. When you go BR, it is likely your accounts will be frozen so you will need to open new ones to receive your benefit payments.

Yes the shortfall should be included in your bankruptcy. If it was joint then the other party would still be liable unless they went BR too.
The account which is a po account should be ok as its just to have benefits paid into.
