Posted - 01 February 2009 : 10:40:11 I’ll rewind back to April/May last year for a moment. Life’s not so bad, I’ve got some recent debt but, nothing I can’t handle I said, and that was true. My outgoings are almost nothing from a £860pcm because I’m crashing at my parents’ house, but that’s another story. About the end of May I got a new job as a postman, I took a hit on the pay but only until my probation was up in November.
September 2008 – Monday Morning
BANG – a letter from the CSA who wanted a slice of my cash, now correct me if I’m wrong but, how do you subtract £220 PW from £210? <start rant> how the F^^K does that work I said to myself ? Robbing B^^^^rds <end rant> then, quit my job. I could do this because I’d enough money for payments for 3 months along with $1000 and 1000 euro in cash in my bedroom. I got talking with a guy that wanted help after Xmas 08 - Brilliant I said, got on my motorcycle and went to Africa, and back!
I don’t want a thread about the CSA, that’s another story, but it was the catalyst for what happens next. You watch the same news as me, people aren’t spending, my friend doesn’t need me because people aren’t spending and, if I get a job I’ll get shafted. I can’t get a job now even if I try hard, the Isle of Wight in winter, I rest my case.
Over the last six weeks I’ve been selling everything on eBay, trying to pay the bills which I’ve done. I’ve got both bikes going now, not much value in them but, they hold off missed payment for a while. Also, it allow me to pay off a couple people who lent me money in harder times, they’re having hard times now like everybody else, another 1500 quid bill between them, brilliant, just what I need. First my job, then my bike.
I recon cut-off point is about end of February. I’m still researching stuff but its not looking good. I’m living on my cards now, only a little, 20/30 quid a time. Petrol in dads car mostly, running around looking for work.
Cards now stand at
1 = 4100 with 8500 limit 2 = 1500 with 3000 limit 3 = 1350 with 1500 limit
Bank Loan 1 - 7k
Bank Loan 2 – 27k – this has a story. They don’t bother me about it but one day they might. In the last big crash of the late 80s I had 4 flats with my Dad. All hell broke out and mum took the bank to court and won, keeping the house that was being used as security. I took a flat at some point, taking the pressure off mum and dad. Might be a bad loan like the original in the rush to give money away! History repeats itself then! Maybe that’s why, but I don’t want that biting me when I’m 60 so it’s on the list.
I’m 45 this year and I’d like the chance at being just a normal skint person. With that lot and the ability for work effectively removed by stupid amount csa payments I can’t see a way out. I'm set on it now i think, 90% sure

Posted - 03 February 2009 : 00:04:07 Last week in the news there was an article on the CSA considering new legistaltion that would allow them to take away passports and driving licenses for parents who don't play by their rules.

Posted - 02 February 2009 : 16:53:22 That money is owing to the CSA in arrears anyway. Quitting your job will not wipe that slate clean, plus you are not providing for your child/ children. Why can't you work??? Why do you have to be skint? Sorry, i don't understand the point you are making. |

as long as you do not sell the bike undervalue the OR can do nothing.
He would, of course, be interested in where the funds from the sale had gone.
Living expenses and court fees will eat that up very quickly.
As to whether bankruptcy is right for you, only you can decide that Shaun. All we can do is answer your questions and confirm from the info given if it is an option or not. |

I guess what I’m asking is, should I just do it, go bankrupt. I’ve been stood at this point a couple times in my life but always put up a fight and turned it around. Now I’ve got nothing to fight with I feel it’s time.
With regards to the bikes, a friend of mine said "that might flag up if you sink now" it’s not my intension to screw anybody over, just pay a couple bills to people that have helped me out in the past and would help again, it’s nice with friends that won’t charge interest.

It does look like bankruptcy would be a good option for you.
With no regular income or assets to protect you wouldn't really be looking at an IVA or a Debt Management Plan and to be honest these are not great solutions anyway.
If you have settled a debt with friends that is technically 'preference' and might earn you a slap on the wrist from the Official Reciever but probably little else as long as the amount was fairly small, even better if you hold off for a few months.
With respect to the CSA payments they cannot obviously take money you don't have. They are notoriously useless but if given full information they should settle on a realistsic figure.
