My debts have gotten out of controll I know I have to go through with the BR it's the only way, my husband knows about it and says he thinks it best. Thing is he now says that he wants a divorce. Long story, but should I go through with the BR BEFORe or AFTER he's divorced me? Does it make any difference? ...I also forgot to say that our tenancy agreement is up in April of this year on the flat we rent, and my husband says he will not renew his side of the agreement which means I am also homeless.... |

Posted - 04 February 2009 : 19:35:53 Just a thought, are all your debts in your sole name? are any joint debts? as if you have joint debts and you solely go bankrupt he will be liable for the whole debt too, despite the fact you have gone bankrupt. It may be wise to try and secure alternative rented accommodation before you go bankrupt as a BO can hinder a credit check by a letting agency. Is there any chance you can remain in your sole name in your current rented property? If this is possible i would say go ahead now, sort your debts out via a BO as trying to sort out your personal life/divorce will take longer and is a much more painful experioence (been there, done that got the t shirt so to speak)compared to a divorce bankruptcy is one heck of a lot easier!

Is this threatened divorce because you have said you might go bankrupt?
If bankruptcy is right for you then you may as well go ahead with it as there don't seem to be any assets to interfere and the divorce will not debt collectors letters, etc.

Posted - 04 February 2009 : 16:42:19 Possibly it would be as well to sort the divorce out first, so that when you go BR your ex is not in the equation in any way. HOWEVER, divorce can take some time so if you are in an urgent situation then you ay well ave to go BR first. Are there any assets? |
