Hello. I am in the process of filling forms for bankrupcy but am confused by present address question. Since july 2008 i have been staying with various friends and have not had my own home. Presently i stay with friends for a couple of months and am paying a nominal 'rent'. They wont let me use their address as a bankrupt. So to answer the question 'Where have you lived for at least three of the last six months?' is nowhere. I have a mailbox. Is that good enough? My ex-partner also refuses to let me use her address for the time pre July 2008. Do i have to get a flat just to be bankrupt? ... ive no money! Please help, its driving me insane!

It will totally depend on the examiner with whom he has his telephone interview, wrong but that's the way it is I'm afraid - he could have someone who totally takes on board everything he states re temporarily with friends, make a note accordingly and that would be the end of the matter, there again he could have someone who is rather pedantic who wants something in writing, which i hope/presume aapjemaan would have no difficulty obtaining from his friends.
Like in all walks of life you have sensible people who understand life as it is, then you have a jobs worth who wants every i dotted and t crossed. As aapjemaan has his post go to a mailbox this will support his claim of temporary residence

hello.

Should aapjemaan ask for a letter addressed to whom it may concern from the landlord stating they will not allow aapjemaan to use that address for the bankruptcy address? this could be submitted just in case the OR asks for evidence that aapjemaan would be evicted and made homeless if aapjemaan revealed their address? i suppose aapjemaan could say no fixed abode and if the examiner asks why aapjemaan can state what has happened and produce a letter if required as proof.

I say this because the examiner is likely to be suspicious why anyone says no fixed abode.

I have dealt with bankruptcy orders (made) on a number of occasions which state Mr.......of no fixed abode, so in your circumstances this may be the option if your friends will not allow you to use their address. I would however add your mailbox information to the address section of the form as the OR will have to contact you in writing. Sometimes you speak to the OR whilst at the Court and book a telephone appointment, other times indiciduals are informed that the OR will be in touch.

Make sure you enquire re reduction in fees etc if you are unemployed (details are available with forms pack from Court)
