I wondered if anyone had had a mortgage with rooftops? or similar experiences as ours...
We sent our keys back for VR in January - but the company wont accept VR until we sign the VR forms - though we have not had the forms they have told us that there is a section which states that we will be responsible for any shortfall.
I've pointed out that in no way what so ever am I signing for shortfall and that I'm going BR.
Theres the catch 22 - I won't sign the forms for VR and they won't send them out because I won't sign! As such they now have a possession hearing in court on the 26th - I've said I'm not attending and have entered a statement electronically.
Any feedback as to if this is OK or advice on further steps I should take?

Posted - 13 February 2009 : 13:02:45 Hi Tim, have no experience with Rooftop, but we are going to be handing keys back to Advantage (morgan stanley) first week in March, i have made it clear that we will not be signing anything. We have a court hearing for 13th March, i wrote to the court and also phoned a few days later to check it was rec'd just outlining the situation, the woman i spoke to at Court said technically they cannot go to Court to gain possession when they are already in possession of the house!!
This must be the same situation throughout the country whoever your lender is, maybe worth giving Paul a ring at Reviva (font of all knowledge lol)
