Hi, I am trying to get the money together to submit my backrupcy which is a struggle as not workin, but my question is, my creditors are sending letters saying they will send a walking consultant or somebody around to discuss my debts as i am not working are they likely to send in bailiffs to take my furniture. my debts are around 15k and as much as i would like to pay my creditors off i am no way in a position to do so, so bankcrupcy is my only solution. also they are all saying that they will now have to make me bankcrupt, what does that mean when they do it.

If you are unemployed and in recipt of benefits (see pack from court which lists qualifying beneifts)you can get the court fee waivied (£150) If you make an appointment with your locak itizens Advice Bureau you can get help from various energy providers to have the hole fee paid on your behalf, this though can only be done by making an appointment with your local CAB who can check your energy provider and in qualifying cases provide the necessary voucher. This will enable you to file for bankruptcy without having to fund the fee. What are your total debts - if under £15k you may be better off waiting for a Debt Relief ORder which comesin into force from 6th April - again you will need to speak with your local CAB as they are providing this service and have the relevant forms etc

Hi,

I'm sure an expert will be in touch soon with a more definite answer. However, from my limited knowledge a baliff can only approach once a company has a court order - if they call prior to this you do not have to allow them access to your home - they are certainly not permitted to remove goods.

If a creditor petitions for BR then they pay your £495 but its doubtful they will if you have no assets as they would never recoup a debt.

Basically hang on in until you have your fee and advise the creditors you are filing for BR - it should keep them off your back foa a while.
