Posted - 19 February 2009 : 20:47:43 Both my husband and I have personal debt, we also have debt as a couple, can we declare bankruptcy as a couple, or do we apply seperately, we have been through debt management and paid into an IVA for nearly 3 years, we own no assets or have any savings, the figure we owe after IVA is still 56K,

welcome to the forum.
In Br you would list all of your sole debts AND your joint debts on your form and hubby would do the same.
The effect is that a joint 10k debt would appear twice.
This is because you are both liable for the full debt not half each.
If you are currently in an IVA then there is a certain procedure to follow before you can petition for Br.
The IVA has to fail first and you will no doubt need a letter from the IVA company confirming that it has failed. If you don't have the letter don't be suprised if the judge or clerk refuse the application.
