Posted - 22 February 2009 : 16:51:46 hi im a bit confused with the question on the forms Q 11.1 when did you first have difficulty paying your debts... our problems started about 10 years ago but weve seemed to plod on with remortgages, loans,paying smaller debts off but always being in debt. its just the begginning of this year i knew we had to do something about it we now have £75000 debt - £35000 from 8-10 years ago and £40000 from the last few years ...im not sure what to put when answering this question. thanks v much |

Posted - 22 February 2009 : 20:35:19 Oh it will be fine for both of you, you should just tell him to be honest and it will make life easier for him, you and the OR. :o)
I dont think they would even expect him to know the in's and out's of it all!
You will feel SO relieved when its over. It leaves you feeling a bit strange because it almost seems to easy and makes you feel like they haven't covered enough!
They will probably work it out for themselves and deliberately put your interview first. It must happen more often than not. Who wants to discuss the in's and out's of their loans and credit cards over sunday dinner eh!!

Posted - 22 February 2009 : 20:28:06 ahh thanks, i hope so, he wouldnt know anything that happened in our joint account over the last 8 years so really all he can say is you'll have to ask wife about that after all he'll be telling the truth all he knows is that we are in debt and we cant pay it back. so all i can say to him is just tell the truth and dont try and cover and make excuses for me (which he probably will but i dont want to be protected) but i suppose thats husbands for you. |

I wish I could remember who it was but I was reading a post a couple of days ago about a couple going BR together and she had most of the debt in her name so her OR interview pretty much covered both of them. His only lasted 20 mins!! jammy eh!
I dont think it will remotely matter if he's not as up to speed with it as you are, it will just make his interview etc shorter and less in depth.
Worst case scenario he should just be honest and say your the one to talk to, but I had my interview on wednesday and she was really thorough but didnt really go into much depth about my debt, I was just briefly explaining "consolidation" "home improvement" "cant remember" she was just fine and genuinely on my side and not that interested. They have to write a report about your case so the phonecall is literally for you to help them word it in a sentence. Much less in depth than your court paperwork even!
Your husband will have an easy ride, he should make himself a cuppa!! :o)

Posted - 22 February 2009 : 20:01:36 hi robin55 thanks for the advice and positivity the only other thing worrying me is ive always dealt with the creditors and im worried my hubby wont know what to say to the OR(hes worried too) even though most of the debts are in my name he hasnt even had a cash card since his ccj so i'll have about 13 creditors and he'll have 4, one of them joint with me he's always just let me get on with it, he didn't know the severity of the debt until a few weeks ago. thanks v much. |

I would recommend being honest and saying you had always taken on debt you could afford to pay back but things became difficult a month or 2 ago when you realised the outcome was BR.
I'm positive you will be just fine saying that.
Its good to have all of these answers and paperwork in front of you for your OR interview to.

Posted - 22 February 2009 : 18:34:27 hi Robin55, thats what i was thinking, if i put years ago are they gonna say well you knew you were in debt why did you take on more debt......do you recomend i say couple of months before BR was when it finally hit us which is in a way true? the thing is while we were remortgaging and paying things off our credit rating was fine even though we were paying reduced payments on a large loan and hubby had a ccj, i was offered credit cards, catalogues, online loans with our bank at a click of a button twice, obviously i took them, but always thought we would be able to pay them but now we cant,not down to losing job or anything just taking on too much trying to pay other things with credit, its a real mess really,thanks for your help |

Posted - 22 February 2009 : 17:08:13 I have a similar situation to yours but I was really relieved that I chose to date my difficulty as just before I went BR, as when I was interviewed I found my OR was specifically asking this question to see if I had taken on any debt knowing I couldn't afford to pay it back.
If I had understood the question differently and dated it back to when and why I began taking credit I think I would have had an awful lot of uncomfortable explaining to do.....
