i went br on 8th april 2008 and will soon be discharged!
however i recently received a letter from the department of work and pensions stating i owed them £500.
when i made enquiries about how i owe this money they told me it was from a crisis loan made over 11 years ago and they had only been able to track me down due to my recent br!
also i have contacted them a number of times asking for some sort of proof of the dept, this has not been provided and the DWP have now sent this dept to a collection agency! the collectors will not discuss the dept unless im calling to make a payment!
and the dwp will not confirm that i did indeed request further evidence from them!
seems they decided it would be easier for them at the DWP if the simply passed the problem onto someone else ie: the dept collectors..
my questions:
are they right in saying the dept is not covered by br?
can they reasonably expect me to pay after such a long time?
is it reasonable for them to refer it to collection agency even though i have requested evdence?
any advice is much appreciated....

Posted - 23 February 2009 : 17:18:37 Technically any debt you owed at the time that you went bankrupt is to be included in the bankruptcy. Send the letter in to the OR and ask that they be added to your list of creditors. If you want more assurity that the debt will be included give the OR a ring and askm
