Posted - 24 February 2009 : 17:01:31 I have my bankruptcy hearing tomorrow but I'm really concerned about two things.
My husband left me in September and as a consequence I lost my job. I have three children and am now surviving on benefits. I have £27,000 of debt and have been advised by debt advisors to apply for bankruptcy. What concerns me is that in January I applied and recieved a payday loan for £130 although I no longer had a job - as I'm guessing this is obtaining money fraudulently, how will this be dealt with and will it affect the decision on my bankruptcy?
Also, I have recieved money from friends and family into my current account to help me out since my husband left - will the OR question this?
I'm so worried about tomorrow, I need this bankruptcy to happen or I don't know what I'll do. I have made stupid mistakes in the past and am willing to pay for them and would be happy to never recieve credit again in my life, I just need to be prepared for what will happen to me.. |

Posted - 25 February 2009 : 14:55:39 great news Dreamcatcher73, pain in the neck the problem with the fees, rules are rules, i'm afraid but at least you'll be able to claim it back, onwards and upwards to a debt free future for you, here's to a good night's sleep tonight hopefully free of worries now that the burden of debt has been lifted from your shoulders

Posted - 25 February 2009 : 12:55:56 I'm back and I'm bankrupt!
All went well, sort of! Had a bit of a last minute glitch when they wouldn't accept my benfits letters to get the reduction in fees as it was a week out of date! Had to call my mum and she dashed to the court with the £150 to save the day! Will get a new letter and claim it back.. Didn't have to see the judge, he just looked at my paperwork and approved it, spoke to the OR on the phone and I will hear from them within a couple of weeks with a date for my telephone interview...
So stage one over with, hopefully stage two will be just as easy, glad it's a telephone interview, get really nervous when face to face with people.
Feel like a huge weight has been lifted

Posted - 25 February 2009 : 09:33:20 Yes good luck everyone, I went BR in August last year and have not regretted it one little bit, the hearing is nerve racking but not as bad as you think you will get out of there wondering why you wound yourself up so much!
It will all be done and dusted in no time and a couple of months down the line once everything is sorted you will feel like a new person.
This forum got me through it couldn't have done it without everyone's help on here it was the only source of advice and support I had and for that I will be ever grateful, I have my life back.
You'll be fine. |

I just wanted to confirm what Melanie said, I had my court date on Monday and can honestly say everything went fine and without any horrible incidents.
I can say that I feel so much better now, I still have a long road ahead of me but just knowing that I took control of the situation and dealt with it makes all the difference.
I wish everyone all the best and keep asking any questions you might have, the advice on this forum is first class, from people who have been in your situation. |

Posted - 24 February 2009 : 17:53:56 Hi there and good luck for your appointment In all honesty i do not think your loan will cause to many problems, the amount is not massive, and we all have done things which in hindsight we wold not repeat. The examiner may stress upon you the foolishness of your actions etc etc...but I don't personally belive it will result in anything untoward happening due to the amount in question.
