Posted - 26 February 2009 : 10:44:58 does anybody know if carers allowance is classed as a benefit to waiver the court cost?thats all my husband gets and its him going bankrupt.i get incapacity benefit and dla but not sure if my benefits count?

I'm afraid not. The main 4 benefits in order to qualify for level 1 court cost reduction are income support, jobseekers allowance, working tax credit (but not if you are also claiming child tax credit) and the 4th escapes me for the minute but it isn't carer's allowance.
However some courts have 2 or 3 levels of reduction and level 2 could be where the household income total falls below a certain amount, I believe it is £15K or £16K per annum.
Best contact the court and ask, also ask how the claim for reduction is made and when. With some you must claim before the hearing and some after.
