Posted - 28 February 2009 : 09:11:19 id like to know your views or advice please.hubby has a mortgage on a flat for 103000.he moved in with me in 2007 and rented his flat out to cover his mortgage payments.he was made redundant in 2007 as well.to cut a long story short he is now 3 months in arrears on his mortgage and the lenders gave him til the end of this week to come up with the arrears otherwise they will start repossession on the flat.there is a tenant in the flat that is moving out on the 31st march and has been paying her rent to the letting agent but the agent hasnt paid my hubby for 3 months ,hence the mortgage arrears.he also owes the leaseholding company of the flat money which he cant pay and owes solicitors 3000 for work they did for a sale on the flat that wont go through. the forms where it asks if anyone owes him money what does he put as the letting agent owes him rent money(he has been down various routes to get the money off the agent and used debt collectors and the agent now has a ccj but has only paid my hubby one months rent this week which he obviously didnt pay his mortgage with as it wasnt enough for the full arrears and it mis advised not to pay creditors in the months leading to bankruptcy.he has court booked for april.he has no choice but to go bankrupt and we live on benefits and have 2 children to provide for.any advise on our situation would be greatly appreciated.thankyou.not sure what to put on forms about money owed as the agent says they dont owe it and that its for their fees!!!(1000 pounds-i dont think so!!).why do the forms ask this?also im not sure what to put on forms at all.i look forward to your help.

Posted - 28 February 2009 : 15:28:07 Hi there when you complete the forms, there is a section 'does anyone owe you money' nyou can list the letting agency there with the amount due and very brief reason. As for the leasholder and solicitors just list them onthe unsecured page as a creditor along with all other debts such as credit cards, loans and overdrafts
