Well, we got there at 9:20, went in and said why we were there and were sent to the main county court waiting room. Everyone was very friendly. We waited til 10 to see the clerk. She checked over our petition, helping us where we'd been confused, got us to sign everything. We handed over the money and were given a receipt. Then she gave us the bible to swear on (she asked if we were ok with the bible), and a card of what we had to read, which was swearing before almighty god that our forms were accurate and our handwriting. This took about 15 mins. Then we were sent back to wait in the waiting room.

We waited 50 mins to see the judge. I recommend taking a book, unless you are bored and want to listen to the chatter of the other people at court (mostly custody stuff today). We were able o go in together. The room was a litle intimidating, and looked like a mini court. The judge was nice old guy, smart dressed but no wig (was very disapointed that he had no wig! for £990, I wanted to see a wig :P).

He asked if we'd taken advice, and who from. He asked if we understood that we'd be bankrupt for a year and our credit file would be damaged for far long. He asked if we definately wanted to do it. Then he signed it, and we were sent out. This took 4 whole minutes :O

We were told the paperwork would get faxed to the OR, and they would call back, so we could go off for a bit. We went outside, and came back in at 11:30 (25 min break). We waited (again!) for the OR to ring, and he finally rang at 11:50. Th court gave us back a copy of the SOA each, and a stamped letter confirming the Judge's decision.

He was very nice, spoke to hubby first. He had been given our letter, but not SOA. He asked Hubs DOB, read through the letter for confirmaion and then asked when we ceased trading. He checked that he had our contact details. He asked for the make/model of his car, reg and if taxed/mot'd. he didnt ask anything about travel/use/value. He then did the same with me. He asked if we had any significant assets or property, which we havent. He asked about bank accounts and we told him we would only keep the cash minder, which he had no interest in (havent had full details from them yet, so it didnt go on SOA, which he said was fine).

He got us to make a note of his name and number as he will be our OR right through, and said to call if any questions.

We will get paperwork to sign (agreeing to rules of bankruptcy, and something for the inland revenue), plus a list of what paperwork inc statements they will want from us. Then they will arrange interview, which should be phone, but might be face to face if needed.

Dont feel much different really :) Hope this helps others who are nervous. Everyone inc OR was really nice and friendly, no-one was judgemental :)

It might be a good idea to give the court a quick ring - I'm in Southend, Essex and saw the OR straight after the judge. Tell a lie I had to walk 100 yards down the road to her office first!

Good Luck, Try not to worry

I took cash, petition and SOA. No paperwork, no ID. I dont think I've heard of anyone who actually saw the OR at their court day

Hello Sparkle

Excellent post. Did you not take any supporting paperwork with you then i.e. copies of bills, statements etc. Do I take it then you just turn up on the day with your copies of the SOA. My appointment is on 23 Mar and didnt know whether to take my boxfile with me incase I saw the OR afterwards. Does anyone think you are better off phoning the court and asking what their individual procedures are?

Thanks, Andy

Well done you! I bet you feel relieved now! Thanks for the detailed explanation of the days events - it has really helped me (my hearing is tomorrow).

I'll go and find my book right now!

Great to hear everything went okay for both of you. I am just praying I get a nice judge and a kind OR as you did. I will be a nervous wreck by tomorrow morning.

All the best to you both for your debt free future.
