Posted - 21 March 2009 : 16:59:52 Hi all,
This has been playing on my mind, when i filled in the forms for bankruptcy i did not put the following:
Capital One credit card account Next catologue Littlewoods catologue
All of the above i do not owe anything to them and don't use them anymore but they are still active.
Also i told them about my bank account of which i owed £950.00 (overdraft) but i did not tell them about the joint account (which was under the same account but just a different card number). But i do not owe anything on the joint account.
Will this affect me?
Last thing, got a phone call the other day from the OR saying that my interview will be on the 27/03/09 with the OR and that they are sending me a questionare, what is involved with this questionare?
I think they said for me to send it back asap, does this mean i have to send it back before i have my interview with the OR, i have tried to get in touch with the OR about this but i can never get in touch as they are always away from their office.
Any help please will be most welcome.
Thanks

Posted - 22 March 2009 : 19:33:40 Hi
my apologies I am not well versed in banking and still can't see how one account number is both a sole and joint account.
Sorry I can't help but I'll have to leave this for someone else to advise you on.

Posted - 22 March 2009 : 19:26:38 Sorry John i think i have worded it wrong.
Basically i have a account with Barclays which is my main Bank account of which i owed £950.00 with a overdraft of which i put down on the form 2.28.
Also on that account i created a joint account so i could pay my ex-girlfriend child maintenance so i could transfer the money to her account... that is the only reason i created (i done it that way to keep things seperate and in order)....but to do this i had to create a new card.
I hope this makes sense, it don't to me...lol, but it was the way Barclays wanted it or how they done things.

Posted - 22 March 2009 : 17:11:22 Hi jaykay
I'm bemused that one account can be both in defecit as a sole account and balanced as a joint account.
I've no wish to appear patronising but if there is a 2nd card holder to the account it does not constitute being a joint account.
Perhaps you could enlighten me.

How about this part of the question which was on my Barclays Card (Current account)
Also i told them about my bank account of which i owed £950.00 (overdraft) but i did not tell them about the joint account (which was under the same account but just a different card number). But i do not owe anything on the joint account.

Posted - 21 March 2009 : 18:39:54 Hi
don't worry about the catalogues if there is a nil balance on both but you do need to give full details of the Capital One card to the OR at interview. I would also cut the card in 2 and pass that over as well. But don't worry we all forget things or are mistaken as to what needs declaring and what doesn't. The important thing is to recognise the omition and inform the OR.
I can't think what questionnaire they are referring to but different OR offices work in different ways. I doubt it requires any info you haven't already supplied via the SoA.
Or it could be that when you took the phonecall the OR's representative wrongly, at the time, thought that you had been declared bankrupt following a creditor's petition in which case there would have been a PIQB to fill in (much the same as the SoA).
Either way you can't complete what you haven't received.
