i have an iva but just realised they will want 40% of any overtime i do at work which was the only thing keeping me a float.
Is it possible to declare bankruptcy while in an iva?

Don't forget though Minty that the overtime is usually only when it is over 10% of your normal wage.

I would have a word with your IP first before thinking of bankruptcy.

You need to fail your IVA i.e. miss three payments in order to claim for bankruptcy. Once your IVA has failed you will get a certificate from your IVA company stating that your IVA has now failed, you will need to provide this to the court.
