Posted - 24 March 2009 : 15:48:57 i have an iva but just realised they will want 40% of any overtime i do at work which was the only thing keeping me a float. Is it possible to declare bankruptcy while in an iva? many thanks in advance paul

Posted - 24 March 2009 : 17:24:00 Don't forget though Minty that the overtime is usually only when it is over 10% of your normal wage.
I would have a word with your IP first before thinking of bankruptcy.

Posted - 24 March 2009 : 15:52:11 You need to fail your IVA i.e. miss three payments in order to claim for bankruptcy. Once your IVA has failed you will get a certificate from your IVA company stating that your IVA has now failed, you will need to provide this to the court.
