Posted - 27 March 2009 : 09:40:27 Hi, I have my court date for tuesday- I currently have £400 in my current account left from my last pay cheque in Jan. This is being eaten into by me having to get by on jobseekers of £60- will they want this £400? |

Posted - 27 March 2009 : 18:48:08 I went BR on Monday. I had £620 in my Cashminder account which I dutifully declared on my SOA. I now have over £1000 in there as my tax credits, Child Benefit and CSA have all gone in. My bank account has remained unfrozen and I have had my OR letter giving me an interview date (April 14) but no mention of any money being seized. Would they normally take it straight away if they were going to? Or can they just do it at any time with no warning....?

Posted - 27 March 2009 : 14:12:03 2stressed, I'm not with Lloyds, but I called my bank to tell them I was going bankrupt next week and to ask if they would freeze the account. They said as I had no debts with them and ran the account well they wouldn't freeze it but to call them after I had done it with all the details and they would let me know if I could keep it, but not to worry they wouldn't just freeze it and leave me with no access to money. They said they would give me time to open a cashminder account with the co-op and get anything transferred if they couldn't keep it open after! They were very helpful and nice so give it a go! Jo x |

Posted - 27 March 2009 : 12:38:21 You may well be ok - they allowed me to keep my account with them. My mistake was sending the debit card to the OR - when I asked Lloyds for another one they would only let me have a cash card which could only be used at their cash points!

Posted - 27 March 2009 : 12:10:45 It depends whether the bank are happy for you to keep the account as it's the bank who freeze the account and not the OR. It might be worth asking them so that you can open a new account if they say no.

Posted - 27 March 2009 : 11:58:51 Im with Lloyds- I do not owe them a penny. I opened specifically with them when I kicked off the IVA process as I knew I didnt owe them. So the account doesn't get cancelled completely- u can get it 'unfrozen' so to speak |

Posted - 27 March 2009 : 11:52:55 Is your account one of your creditors? If so you will need to open a new one.
I the account is frozen you will need to OR to write to the bank and tell them that they have no interest in it.
Which bank are you with?

Posted - 27 March 2009 : 11:19:07 withdraw it all hon (even my OR said this was the best thing to do!). I think that as long as your expenditure on your I&E comes to more than £400, they wont be fussed (I think hubby and I had 440 in total on BR day) |

Posted - 27 March 2009 : 10:48:12 Hi, You can have your benefits paid as a Giro, as i`m doing at the moment....but you need to act fast, as they start the payment process to your bank, a week before its due. |

unless you identify that the £400 is there for essential expenditure then it would be claimed.

I believe, and I'm sure I'll be corrected if I'm wrong, that you need to withdraw this as the account will be frozen after the BR.
