Posted - 27 March 2009 : 16:49:45 Hi I have been informed by my IVA company that i am now £686 in arrears and 2.6 months behind once i get to April 21st it will then be the official 3 months behind and i will receive my default notice two weeks after that. Whilst I am looking for a job still, and hoping that i can still eventually sort myself out, I know that I might have to file bankrupsy. I wonder if anyone can tell me at what stage I need to start getting another account and filling out forms etc... I am married and we have a council flat, the debt on the Iva is solely mine so it will only be me that files for rupsy. Can anyone tell me if any of my husbands stuff will be taken into account as the debt is mine. Thankyou |

Posted - 27 March 2009 : 18:28:10 I had the same worry as you Shazzles, but the OR didn't even mention my OH's things. As Jan says I would give the court a call in case there's a waiting list.

Posted - 27 March 2009 : 17:08:32 I think that your husbands stuff will be ok if the debt is all yours.
Did you change your bank account for your IVA? If so, and you have no debt with this bank you should be ok to keep it (subject to the bank themselves closing the account, which some of them do).
The forms for BR you can fill out yourself:

As soon as you get your termination certificate from your IP, then you can file for BR. I would check with your local court now though as to whether there is a waiting list or not. If there is, and it is a decent one, you can make an appointment now.
