Posted - 28 March 2009 : 17:43:12 Hi
just a couple of quick questions as I complete my forms. Firstly, I'm sure I'm correct in thinking that existing CCJs won't be covered by BR, but could an expert confirm this for sure? Secondly, will debts be covered by BR where there is an impending Court hearing (i.e. notification of the date, but not the hearing or CCJ itself, prior to my BR date) - I'm having great difficulty in keeping my creditors at bay, having offered the absolute maximum I can afford but to no avail, therefore fully expect notification of Court dates soon.
As ever, any assistance greatly appreciated.

Posted - 28 March 2009 : 21:28:27 Hi
the only debts that cannot be included are.
Court fines ( speeding tickets, parking fines like the congestion charge, non payment of TV license) Student Loans ( proper government provided student loans).
I would suggest you treat everyone equally and don't pay anyone - you will save up the court fee that bit quicker

Posted - 28 March 2009 : 19:09:13 Many thanks, Reviva. It's great news that my existing CCJ will be covered by my BR (Court date 1st May) as I was convinced this would continue - I'm sorry to have to say this, but this was advised by my local CAB. I'm hugely relieved as I really didn't want any debt continuing to hang over me; I need to be free from this now for the good of my health!
It's a common story I suppose; I'm out of work at the moment on health grounds and have tried for several months to negotiate payments with the more aggressive of my creditors (particularly the ones now handled by debt collectors) and have carried on making token payments (only £5 pcm but the maximum that I can afford). They've stated repeatedly that this is insufficient, despite phone calls, letters and income/expenditure breakdown from myself, and a few days ago I received a date for county court in respect to one such debt, scheduled for after my BR. So, again, many thanks for putting my mind straight on this. |

all CCJ's are covered by BR
When you say you are having trouble keeping your creditors at bay - why is this.
You shouldn't believe absolutely everything they say.
Only focus on the CCJ's - as it would be better not to get to bailiff stage.
Without a blue & white county court claim form then there is actually nothing they can do but phone you up, amd write letters.
You need to focus on the time it will take to save for court and work out what you can do to speed this up.
Absolutely no point in making any payments at all to creditors that haven't got a CCJ in place.
You probably have lots more time than you think
