Posted - 30 March 2009 : 15:10:46 Hi I have just joined this great site and would like some advice please. I was made bankrupt Dec 08 for a debt of £4,031.98. The unsecured creditor petitioned for my bankruptcy and i was made bankrupt because I could not afford to pay. The unsecured creditor sent me a statutory demand and in this he claimed I owed him £2,978.75., what I would like to know is what is the extra £1,053.23 for. And if he has issued me with a statutory demand then should that not be the full amount I owe to this creditor. I am very confused in this matter. |

Posted - 30 March 2009 : 17:35:09 Hi any interest should have been included in the claim amount.
My guess is they are trying to recover the costs of petitioning the court for your bankruptcy which can be anywhere between £1000 and £2000.

Posted - 30 March 2009 : 17:03:23 Definitely sounds a bit dodgy. When the creditor was chasing you for the debt before you were made BR was it for £2978 or £4031? Maybe the extra £1053 was for 'Administration Fees' as this seems to be one that companies use to boost the amount people owe.
It may be that if you have already been made BR that it is too late to quibble about the amount as this should probably have been resolved before going through the bankruptcy process.
