Posted - 30 March 2009 : 22:15:00 Hi guys, I think I posted this accidentally on the Bailiffs forum??? thank goodness for Copying and pasting.
Hi Everyone.
Have just received the form from NR after I phoned them about voluntarily surrendering the house which I have now vacated. Have read lots of posts around mortgage shortfalls etc, and not signing forms. Am I right in believing that I can cross out the paragraph that says "if the sale proceeds are insufficient to pay off the total amount oustanding NR ...... reserve the right to recover the shortfall" but can sign the form?
The form asks for a forwarding address, I really do not want to put my new rented home on the form as I do not want this house linked with any aspect of my BR, can I just put a friend or family member's address as a c/o?

Posted - 31 March 2009 : 21:40:46 Thanks Jurgenpie. I don't think I will even send the form back now, just post the keys etc, as I don't want to give my new address to NR. Janel mentioned in this thread that NR visited her a couple of days after giving the details??!!!?? Yes with the council tax I think I will do the same. Thanks for advice. Roll on the 7th!! |

Posted - 31 March 2009 : 21:29:13 I replied on other forum as well, Northern Rock did the same to me and the OR told me just to delete the clause and send the keys back, in regards to the Council Tax I was in the same boat and there is a clause in the Council Tax rules which cover bankruptcy and leaving property unoccupied, I sent a copy of the bankruptcy certificate and my tenancy agreement at my new address and they were happy with that and advised no charges will be made, the house is still up for sale even now a year later.

Thankfully I have only given my forwarding address to home insurance (buildings) on my old property and Council Tax as I thought it would help them to see that I am paying another borough for council tax? I rang my old authority again today and spoke to a much more helpful person who said he will put my account on hold for 30 days so gives me chance to get some proof of BR once the deed is done on the 7th.

that's a valid point of course which I confess I had not considered. Zoe is the expert on Council Tax and I believe I may have suggested you direct your question to her in a previous thread.
I guess it depends on what detail they require to confirm non occupancy. I don't see it as fair that the only proof the council would accept must come from the lender.
It's only a thought but maybe some photo's of the empty premises, digitally dated if possible, together with a copy of the accompanying letter to the lender and a copy of your rental agreement on the new property may suffice.

Posted - 30 March 2009 : 23:11:34 Thanks John. So scarey!!! but reckon I will do that then? I was just worried cos my council tax are asking for a letter to confirm non-occupancy. I had response from Zoe who said I need to give details etc. I have changed Council Tax borough so shall I just ignore any reminders for the new financial year payments from my previous one (who I never missed payment before) and include it in the BR even though I have submitted my forms weeks ago? |

I wouldn't sign the form at all nor return it or advise the lender of your forwarding address. Just send the keys back in a jiffy bag recorded delivery with an accompanying letter giving the address to which the keys belong.
Let the lender deal with the property through the OR.
