Posted - 03 April 2009 : 14:10:49 I was told by an accountant yesterday that the OR will also take into account my attendance allowance and also my mobility payment when calculating my income. Is this so because I am disabled and often need help in the house and the running cost of my vehicle. T.I.A |

Posted - 03 April 2009 : 20:43:29 IVAs are only for people with income that leaves disposable income after outgoings. If you prefer not to post personal info on here you can e-mail or call the experts directly through the expert link on the left hand side of the page.

You wont be allowed to apply for an IVA with benefits as just income, BR may be an option if you could post more details of your outgoings, debts and total income from what type of benefits someone can advise further.

Posted - 03 April 2009 : 17:21:41 cheers good buddies but because the situation is very new to me I am still deciding whether to apply for an IVA or out and out BR. Would there still be a difference between the two above in respect of those benefits. Sorry if I appear to be a little dim but, the anxiety is getting in the way of straight thinking. |

Posted - 03 April 2009 : 14:50:08 Ok that took less time than i thought.. http://www.insolvency.gov.uk/freedomofinformation/technical/TechnicalManual/Ch25-36/Chapter31/part7/part2/part_2.htm
Section 31.7.9 shows that if your only income is benefits then you are ok, if you earn a wage and get benefits and it can be shown you have DI then the most the IPA can be is equal to the wage income not benefit income. Unless you want to voluntarily give the OR some of your benefits!!!!!!

Posted - 03 April 2009 : 14:41:01 Firstly welcome to the forum. you are in the right place to ask questions.
I have read that some benefits are not counted towards total income, but some are and if combined with a wage income can lead to Disposable income DI. I'll check which benefits count, the only one i'm sure of at the moment is child benefit , that is NOT income.
