Posted - 06 April 2009 : 17:31:54 Up until today I was under the impression from letters I had received from my iva company that they were holding funds to petion for my bankruptcy if necessary I have lost these letters and after speaking to them today they deny that they retained funds,I know they sent me letters stating this but how can I prove it without the letters. So looks like I'm going to have to do it my self but I haven't got a clue what I need or what to do, please could anyone help. |

Posted - 06 April 2009 : 19:28:50 Your default notice should arrive quite quickly, I would ring the IP up and ask them to send it asap.
Phone your court up to see what you have to do - it may be that they have a waiting list and it might be worth your while making an appointment now if that is the case.
I wouldn't worry too much about the bailiffs coming round, it takes a while for the creditors to get to that stage.

Posted - 06 April 2009 : 17:55:04 I miss my 3rd payment on 30 April, how long after that will I have to wait for certificate. Also I'm worried in case creditors start sending bailifs round before I can petition for my bankruptcy, I could probably manage to find the fees in the next month or so. |

Posted - 06 April 2009 : 17:39:04 Hi,
Take a look at this site:
http://www.insolvency.gov.uk/
it will tell you all you need to know about BR. You can fill the forms in online and save them as you go along.
You will have to wait until your IVA has failed and you have the termination certificate. Phone up your local court to see if you have to make an appointment or if you can just go on the day.
It will cost you £510 to petition for a single bankruptcy.
This site is an invaluable place for asking for any advice, help with the forms, or support that you need.
