My husband has been asked to submit a tax self assessment for 08/09 which is no problem as we have the info they need. Really he shouldn't need to fill it in as he wasn't self employed or a director etc. Because he only earnt approx £7k during this tax year he may be entitled to a tax rebate. How does this stand with our plans to go bankrupt?? It won't be a huge amount obviously but would we have to hand it over to the OR or could it be used for essential living expenses??

We plan on going BR in the next month or so.

If your husband was to file for bankruptcy any tax rebate may be payable to the OR as an asset
