hi all, we went bankrupt 16th of march but took out a payday loan (£350) on around the 3rd of the month, im not going to lie....we did know we were going to go bankrupt, but this was going towards the fee (£1000)and at the time did intend to pay it back, however...with all the stress and panic, add to that the fact that we moved house and changed bank accounts all within a short period of time, me and my wife genuinly forgot all about it! we know we shouldnt have got it in the first place...but we did, we were struggling to get the fees together... what will happen to us??

am i correct in thinking that it just stops me from obtaining credit for a longer period? will we still be discharged after 12 months?

Hi

first of all you need to inform your examiner and add this creditor to his list.

I'm sure you are aware that a loan of this nature so late prior to declaring bankruptcy is not great news as any loan taken out when you know you will be petitioning the court could be construed as fraud.

In my opinion and looking at the sum involved and the purpose of the loan a slap on the wrist for the pair of you is the most likely outcome.

I do however suspect that if the slap on the wrist is all you do receive then a BRU will be proposed at some stage for you both.

Hi Sinkinship
First of all welcome to the forum,
An expert will come along soon,
In the mean time Don't panic about it, what is done is done, you can not change it.
The OR probaly won't be happy about it,
when you have the interveiw , just be honest,
And obviously you can not pay the money back as it will be seen as preferencal payment.
